1. Introduction and Acceptance

Welcome to EnhancePhoto. These Terms of Service ("Terms") govern your access to and use of enhancephoto.org, including AI image generation, image editing, templates, account history, credits, subscriptions, downloads, and related features (the "Service").

By accessing or using the Service, you agree to these Terms, our Privacy Policy, and our Acceptable Use Policy. If you do not agree, do not use the Service.

2. Eligibility and Accounts

You must be at least 13 years old to use the Service. If you have not reached the age of legal majority where you live, you may use EnhancePhoto only with permission from a parent or legal guardian who accepts these Terms on your behalf.

You are responsible for providing accurate account information, protecting your login credentials and sessions, and promptly contacting us if you suspect unauthorized access. You may not create accounts through automated or deceptive means, impersonate another person, sell or transfer an account without permission, or bypass account, credit, rate, safety, or security controls.

3. Service Description

EnhancePhoto provides an interface for creating and editing images with text prompts, uploaded or reference images, templates, output controls, and AI models supplied by EnhancePhoto or third-party providers.

Public pages may be browsed without an account. An account is required to generate images, keep creation history, continue editing, and manage credits, subscriptions, or billing.

Models, features, pricing, credit costs, processing times, output quality, supported formats, and availability may change. EnhancePhoto is an independent product and is not affiliated with or endorsed by an underlying model provider unless we expressly state otherwise.

4. User Content and AI Processing

"User Content" includes prompts, uploaded images, reference materials, editing instructions, feedback, support attachments, and other content you submit to the Service.

You retain the rights you lawfully hold in your User Content. You grant EnhancePhoto and its service providers a limited, worldwide, non-exclusive license to host, copy, transmit, modify, and process User Content only as reasonably necessary to provide, secure, support, and improve the Service, comply with law, and enforce these Terms.

Prompts, images, and generation settings may be sent to third-party AI, storage, and infrastructure providers. You represent that you have all rights and permissions required to upload and process User Content. Do not submit confidential material, personal data you are not authorized to use, or content that infringes intellectual-property, privacy, publicity, or other rights.

5. AI Outputs and Usage Rights

Subject to applicable law, these Terms, your plan, and any model-specific restrictions presented through the Service, you may use outputs generated through your account.

However:

• AI outputs may be inaccurate, incomplete, similar to content generated for others, or unsuitable for your intended use.
• EnhancePhoto does not guarantee that an output is unique, non-infringing, eligible for copyright protection, or cleared for commercial use in every jurisdiction.
• You are responsible for reviewing outputs before publishing, distributing, selling, relying on, or using them in professional, legal, medical, financial, advertising, identity, or other sensitive contexts.
• Third-party model terms and technical restrictions may apply to particular outputs.

EnhancePhoto does not claim ownership of your lawful User Content merely because you process it through the Service.

6. Acceptable Use and Prohibited Content

You may not use the Service to create, upload, request, distribute, or facilitate content or activity that:

• Violates applicable law or another person's intellectual-property, privacy, publicity, contractual, or other rights.
• Is NSFW, explicit, sexually suggestive, sexually explicit, pornographic, exploitative, otherwise harmful, or involves non-consensual intimate imagery.
• Sexually exploits or endangers minors, depicts child sexual abuse material, or sexualizes a person known or reasonably believed to be a minor.
• Uses face swap, deepfake, identity replacement, or other face-manipulation techniques to impersonate, deceive, sexualize, harass, or materially misrepresent a real person.
• Promotes hatred, targeted harassment, terrorism, violent extremism, credible threats, or serious harm.
• Facilitates fraud, impersonation, identity theft, deceptive political or commercial practices, or misleading representations of real people or events.
• Contains malware, phishing, credential theft, spam, scraping abuse, denial-of-service activity, or attempts to compromise systems or users.
• Attempts to bypass safety filters, credit limits, rate limits, access controls, or other technical restrictions.
• Interferes with the Service, reverse engineers protected systems where prohibited, or uses automated access without permission.

Our Acceptable Use Policy provides additional examples and enforcement details. Prompts may be screened before generation by EnhancePhoto, Creem, and other safety providers. We may refuse requests, block or remove eligible content, limit features, suspend accounts, or cooperate with lawful authorities when we reasonably believe there is a legal, safety, payment, abuse, or security risk. If mandatory screening is unavailable, generation may be temporarily blocked rather than processed without review.

7. Credits, Subscriptions, Billing, and Cancellation

Paid plans, subscriptions, promotional credits, and credit packs are governed by the price, currency, billing period, credit amount, validity period, product entitlements, renewal terms, and payment-provider terms shown on the pricing page or at checkout.

Credits are a limited license to access eligible Service features. They are not money, cannot be redeemed for cash, and may expire as disclosed when granted or purchased. Credit costs may vary by model, resolution, quality, output count, processing mode, or feature.

Subscriptions may renew automatically until canceled. You can cancel through the available billing or subscription-management interface. Cancellation generally prevents future renewals but does not reverse access or benefits already provided for the current billing period, except where required by law.

8. Refunds and Support

Because AI generation, digital credits, and subscription benefits can be delivered or consumed immediately, purchases are generally non-refundable after credits or paid features have been delivered or used.

We may review duplicate charges, billing errors, material technical failures, or other exceptional circumstances case by case. Nothing in these Terms limits refund or cancellation rights that cannot legally be waived.

For billing, refund, or product-support questions, email support@enhancephoto.org. Include your account email and relevant order information, but do not send complete payment-card details.

9. EnhancePhoto Intellectual Property

EnhancePhoto's software, interface, branding, original graphics, documentation, and other Service materials are owned by EnhancePhoto or its licensors and are protected by applicable intellectual-property laws.

Except for rights expressly granted in these Terms, no rights are transferred to you. You may not copy, sell, sublicense, or commercially exploit protected parts of the Service, remove proprietary notices, or use EnhancePhoto branding in a way that suggests affiliation or endorsement without permission.

10. Suspension, Termination, and Service Changes

You may stop using the Service at any time. Where available, you may close your account through account settings or by contacting support.

We may limit, suspend, or terminate access when reasonably necessary to address violations of these Terms, non-payment, fraud, abuse, security risks, legal requirements, or harm to the Service or others.

The Service may experience delays, queues, maintenance, provider outages, model changes, content-filtering decisions, failed generations, or data loss. We may add, modify, suspend, or discontinue features, models, plans, or parts of the Service. Continuous or error-free availability is not guaranteed.

11. Disclaimers and Limitation of Liability

To the maximum extent permitted by law, the Service is provided "as is" and "as available." EnhancePhoto disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, and that outputs will meet your expectations.

You are responsible for backing up outputs you wish to keep and deciding whether the Service and any output are appropriate for your use.

To the maximum extent permitted by law, EnhancePhoto and its providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, business opportunities, or use arising from the Service.

Where liability cannot be excluded, EnhancePhoto's aggregate liability for claims relating to the Service will not exceed the greater of the amount you paid to EnhancePhoto during the three months before the event giving rise to the claim or USD 100, unless applicable law requires a different amount.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless EnhancePhoto and its service providers from claims, damages, losses, liabilities, and expenses arising from your User Content, your use of outputs, your violation of these Terms, or your infringement of another person's rights.

12. Changes to These Terms

We may update these Terms as the Service, providers, pricing, or legal requirements change. The revised Terms will be posted on this page with an updated date. Continued use after the effective date of revised Terms means you accept them, except where applicable law requires another form of consent.
